PickWarriors Free Tournament Terms of Service

These Free Tournament Terms of Service ("Terms") govern your participation in any tournament on the PickWarriors platform ("Platform"), operated by Cala Holdings LLC ("PickWarriors," "we," "us," or "our"). By creating an account and joining a tournament, you agree to be bound by these Terms in addition to PickWarriors' general Terms of Service.

If you do not agree to these Terms, do not use the Platform.

1. Nature of Competition

PickWarriors tournaments are free, skill-based competitions. Participants predict the outcomes of real sporting events based on their knowledge, analysis, and judgment. Results are determined entirely by actual sports outcomes — no element of chance or random number generation is involved in determining standings.

PickWarriors is not a gambling operator, sportsbook, casino, or fantasy sports operator within the meaning of any state licensing regime. Participation in tournaments does not constitute gambling under the laws of the State of Indiana, USA, which governs these Terms.

2. No Payment, No Prizes, No Items of Value

PickWarriors tournaments are completely free to enter and play. There are no entry fees, subscriptions, in-app purchases, premium tiers, deposits, or payments of any kind required to access any feature of the Platform.

Participants do not earn or receive:

  • Monetary prizes or cash payments
  • Cryptocurrency, virtual currency, or in-app currency
  • Redeemable points, tokens, or credits
  • Physical merchandise, gift cards, or vouchers
  • Any other item of monetary value or that can be exchanged for an item of monetary value

Participants compete solely for placement on public leaderboards and personal streak records. These are non-transferable, non-redeemable, and have no cash or commercial value.

3. Eligibility

To use the Platform you must:

  • Be at least 13 years of age (or the minimum age required to consent to data processing in your jurisdiction, whichever is higher)
  • Have a valid, active PickWarriors account in good standing
  • Comply with all applicable laws in your jurisdiction

PickWarriors reserves the right to verify eligibility at any time and to suspend or terminate any account that does not meet these requirements.

4. Tournament Participation

4.1 How Tournaments Work

PickWarriors offers two tournament formats:

  • Pick'em Pools — Participants predict the outcomes (Home win, Draw, or Away win) for a round of matches. Points are awarded for correct predictions, and standings are displayed on a public leaderboard.
  • Streak Warriors — Participants pick one match at a time and try to build the longest streak of consecutive correct predictions. An incorrect prediction resets the streak to zero.

4.2 Match Data

Match data, schedules, and results are sourced from licensed third-party sports data providers. PickWarriors does not claim affiliation with, endorsement by, or sponsorship from any sports league, governing body, team, or player.

4.3 Standings and Leaderboards

Standings are calculated automatically based on the official results of the underlying sporting events as reported by our data provider. PickWarriors decisions regarding standings calculations are final.

5. Prohibited Conduct

The following conduct is prohibited and may result in immediate disqualification, suspension of leaderboard placements, and permanent account termination:

  • Creating multiple accounts to participate in the same tournament or manipulate any leaderboard
  • Using another participant's account for any purpose
  • Allowing another person to use your account for any purpose
  • Colluding with other participants to manipulate results or standings
  • Using automated tools, bots, scripts, or any other automated process to make picks or interact with the Platform
  • Providing false identity or registration information
  • Selling, transferring, or sharing account access with any other person
  • Attempting to interfere with the Platform's operation or security
  • Refusing to cooperate with any account verification or investigation if requested

For violations, PickWarriors may, at its sole discretion:

  • Suspend or permanently close your account
  • Remove your standings from any leaderboard
  • Disqualify you from current and future tournaments

6. User-Generated Content

If you create custom tournaments, group names, display names, profile images, or other content visible to other users, you agree not to submit content that is unlawful, defamatory, obscene, hateful, infringes any third-party intellectual property rights, or otherwise violates the PickWarriors community standards. You retain ownership of content you submit but grant PickWarriors a worldwide, royalty-free license to host, display, and distribute that content within the Platform.

PickWarriors reserves the right to remove any content at its sole discretion.

7. Account Inactivity

A PickWarriors account is considered inactive when no login or tournament activity has occurred for 24 consecutive months. PickWarriors reserves the right to close inactive accounts after providing reasonable notice to the email address on file.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKWARRIORS AND CALA HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN TOURNAMENTS OR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF LEADERBOARD PLACEMENT, TECHNICAL MALFUNCTIONS, INTERRUPTIONS TO SERVICE, UNAUTHORIZED ACCESS TO YOUR ACCOUNT, OR ERRORS IN STANDINGS CALCULATION.

YOU ACKNOWLEDGE THAT YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. PICKWARRIORS PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9. Indemnification

You agree to indemnify, defend, and hold harmless PickWarriors, Cala Holdings LLC, and their respective officers, directors, employees, agents, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) any false information you provided during registration.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict of law principles.

10.2 Binding Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Carmel, Indiana, under the rules of the American Arbitration Association (AAA), conducted in the English language. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration. Each party is responsible for its own costs and attorneys' fees unless otherwise required by law.

10.3 Class Action Waiver

BY ACCEPTING THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST PICKWARRIORS OR CALA HOLDINGS LLC. All disputes must be resolved individually through arbitration as described above. No arbitrator shall have the authority to consolidate claims or preside over any representative proceeding.

11. Miscellaneous

11.1 No Third-Party Beneficiaries

These Terms are solely between you and Cala Holdings LLC. No third party shall have any rights or remedies under these Terms.

11.2 Non-Assignment

Your rights and obligations under these Terms are personal to you and may not be assigned or transferred to any other person without the prior written consent of PickWarriors. PickWarriors may assign these Terms at any time without restriction.

11.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

11.4 Waiver

The failure of PickWarriors to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

11.5 Entire Agreement

These Free Tournament Terms of Service, together with PickWarriors' general Terms of Service and Privacy Policy, constitute the entire agreement between you and Cala Holdings LLC with respect to tournament participation, and supersede all prior agreements, oral or written, on this subject.

12. Changes to These Terms

PickWarriors may update these Terms at any time. When we do, the version number and effective date will change. Continued use of the Platform after an update constitutes acceptance of the updated Terms.
